1. Services

BirthInk provides education, guidance, and support for mothers and families regarding pregnancy, birth, and breastfeeding.

• All services are educational and supportive.
• BirthInk does not provide medical advice or replace care from qualified healthcare professionals.
• Clients should consult their healthcare provider for any medical concerns.

2. Website Use

By using the BirthInk website, you agree to:

• Use the website legally and responsibly
• Not misuse the website (e.g., hacking, spamming, or interfering with its operation)
• Respect the intellectual property of BirthInk and third parties
• Not copy, reproduce, or distribute content without written permission

3. User-Generated Content

If you submit content (messages, testimonials, or photos) to BirthInk, you grant us a non-exclusive, worldwide licence to use it for educational or promotional purposes.

Content shared publicly on social media or the website may remain visible indefinitely, and BirthInk cannot guarantee its removal from third-party platforms.

By engaging with BirthInk services, you acknowledge this use.

4. HypnoBirthing — Bookings & Payments

• Group course: RM1,480 per couple, deposit 25% (RM370). Private course: RM2,900 per couple, deposit 25% (RM725).
• The balance is paid either in full at Class 1, or split equally at Class 1 and Class 3.
• Moving to a later intake, or joining an intake that has already started, is by arrangement with Ruzanna.

Cancellation policy

Group Classes are intended for small settings, this allows the educator to teach and maintain quality of attention to each individual. Private Classes timings are arranged just for you. When you sign up for this Course, you have chosen the schedule that best fits your preferences. The spot is reserved just for you and your partner. All sessions are conducted live to create an immersive and effective learning experience that cannot be duplicated through recorded sessions, which is why we do not indulge in providing recordings. A cancellation or missed class leaves a hole that could have been filled by another couple. Therefore:

1. All Course fees are non-refundable.

2. No refunds made for missed/cancelled classes.

3. No pro-rated fees will be applied for missed class(es) - the Course fee applies to the entirety of the programme and services provided during the course period.

Rescheduling policy

1. Private Replacement Classes – In the event of a missed class, a private replacement session may be arranged at a fee of RM300 per session.

2. Replacement in Ongoing Schedules – Participants who miss a class may request to join a replacement class from another ongoing schedule without any additional fee. Participants need to check for availability before attending.

3. Postponement by Instructor – Due to the nature of the Instructor’s work as a doula (serving birthing clients), classes may occasionally require postponement. In such instances, the class will automatically be rescheduled to the following week unless alternative arrangements are communicated. Such postponements are rare and all reasonable efforts will be made to avoid them. (Note: This typically occurs twice per calendar year.)

5. Birth Doula Support — Bookings & Payments

Full terms are in the doula agreement, shared before booking.

Fees

i. Full Birth Support - RM3,100 (Physical Presence during Active labour until 2 hrs after birth of baby)

This agreement commences upon signing and a non-refundable retainer fee of RM1,000 is made.

This is a time sensitive agreement, please check with me for availability prior to signing.

Bookings made after 34 weeks are subject to a late booking surcharge of RM150 per week and a retainer of RM2,500 instead of RM1,000.

Final payment payable within 7 days after birth, unless otherwise agreed in advance.

ii. Travelling charges:

1. Outstation/Multiple trips - RM0.50 per kilometre travelled above the 50 km aggregated allowance.

2. Toll - may be charged as per current rates.

iii. Extended time - Physical presence over aggregated 8hrs may incur additional charges of RM30 per hour.

iv. Optional add-ons are listed and chosen during registration. Extra prenatal appointments are RM120 per hour and RM60 per extra half hour. Birth pool rental is RM200 for the first week and RM20 per extra week.

Termination and refund

i. Once service has commenced (including but not limited to: Pregnancy Support through text/calls, Prenatal Visits, Birth Plan Discussion, Advice on Dr) - No Refunds.

ii. Upon commencement of On-Call Period - Full fees are applicable, even in scenarios such as:

1. Choosing to terminate my services (including caesarean and you no longer require my services).

2. Error on your part - Failing to call in time, abruptly changing the meet-up location, providing inaccurate/false information. Please make mobile phone calls (not WhatsApp calls) & texts.

3. In unexpected circumstances such as (including but not limited to) precipitous birth, unexpected preterm, or medical emergencies preventing attendance, I will still go to either your home or hospital to be with you, with no refund and full payment is required.

iii. Due to my own circumstances (illness, injury, family emergency or at another birth, etc.):

1. If a backup doula is provided, full fees are applicable.

2. If replaced with virtual support, the fee is reduced by RM1,500.

iv. I reserve the right to terminate services immediately in cases of verbal or physical abuse or inappropriate behaviour by you or your support person or any third party present. No refunds issued. If I have already started Labour support then full fees are applicable.

6. Pregnancy & Birth Consult & Parent Prep — Bookings & Payments

• Zoom consultations: RM150 per hour; WhatsApp support week: RM150 for 7 days; breastfeeding home visits: RM150 per hour plus travel; Parent Prep classes: RM350 per class (RM250 for HypnoBirthing students).

Pregnancy & Birth Consult: Booking fee

The consultation fee confirms your session and is non-refundable.

Pregnancy & Birth Consult: Postponing

Postponing is free with at least 48 hours' notice. With less notice, a RM50 postponement charge applies.

Pregnancy & Birth Consult: Missed sessions and no-shows

Missed sessions and no-shows forfeit the fee.

Pregnancy & Birth Consult: Home visits

Breastfeeding home visits add travel: RM0.50 per km for the return journey (there and back), plus tolls.

Parent Prep: Fees

Class fees are non-refundable. Missed sessions and no-shows forfeit the fee.

Parent Prep: Postponing

Postponing is free with at least 48 hours' notice. With less notice, a RM50 postponement charge applies.

Parent Prep: Classes at your own address

Classes at your own address add travel: RM0.50 per km for the return journey (there and back), plus tolls.

7. Downloadable Resources

• Downloadable resources are for personal, non-commercial use only.

8. Intellectual Property

The website content, including text, images, graphics, logos, and materials, is owned by BirthInk.

You may not copy, reproduce, or redistribute content without written permission.

9. Privacy

Your personal data is collected and used in accordance with our Privacy Policy.

By using the website or services, you agree to the collection, use, and storage of your personal information as described in the Privacy Policy.

10. Limitation of Liability

• BirthInk is not liable for any direct or indirect losses arising from your use of the website or services.
• All services and content are provided "as is" and "as available."
• BirthInk does not guarantee specific outcomes from using our services.

11. Links to Third-Party Websites

• The website may contain links to external websites.
• BirthInk is not responsible for the content, privacy policies, or practices of any third-party websites.
• Visiting these links is at your own risk.

12. Marketing & Collaborations

• We may use your information to contact you about updates, future services, or promotions.
• We do not sell your personal information to third parties for marketing purposes.
• We may share information with trusted collaborators or service providers to deliver our services or comply with legal requirements.

13. Governing Law & Disputes

These Terms are governed by the laws of Malaysia.

Any disputes will be resolved under Malaysian law.

14. Changes to Terms

BirthInk may update these Terms at any time. Updates will be posted on this page with a new "Last updated" date.

Continued use of the website or services constitutes acceptance of the updated Terms.
